Jesse Oñate Real Estate ("we," "us," "our") operates jessetek.net (the "Site"). This Privacy Policy explains what information we collect, how we use it, and your rights — with specific compliance for the California Consumer Privacy Act (CCPA/CPRA), the California Online Privacy Protection Act (CalOPPA), and the Telephone Consumer Protection Act (TCPA).
1. Information we collect
You give us directly
- Contact details: name, phone, email, property address (when you submit a form for valuation, the buyer guide, the rate text, or to book a call)
- Form responses: bedrooms, sale timeline, buyer readiness quiz answers, etc.
- Communications: messages you send by email, SMS, or contact form
Automatically when you visit
- Usage data: pages viewed, time on page, referrer, device type — collected via Google Analytics 4 and Vercel Web Analytics
- Performance data: Core Web Vitals (LCP, CLS, INP, FCP, TTFB) for site optimization
- Approximate location: derived from IP address (city/region level only, never precise GPS)
- Cookies: see Section 6
From third parties
- Property data: when you request a home valuation, we query the RentCast Property API for an automated estimate based on the address you provide
- Mortgage rates: we display public Federal Reserve (FRED) data for the 30-year fixed rate; no personal data is sent to FRED
- Google Maps: embedded maps on city pages may use Google Maps cookies per Google's privacy policy
2. How we use your information
- Respond to your inquiry (valuation, buyer guide, calls, etc.)
- Send you the weekly mortgage rate text (only if you opted in on /rates) or other communications you requested
- Improve the Site, including optimizing page performance and content
- Comply with legal obligations (real estate disclosure laws, IRS reporting, etc.)
- Defend against fraud, abuse, or unauthorized access
We do not sell or rent your personal information to third parties for their marketing purposes.
3. Service providers
We use the following third-party services. Each has its own privacy policy that governs how they handle data:
- LeadConnector / GoHighLevel (Jtek): CRM and SMS delivery — receives your contact info and form responses
- Vercel: website hosting, edge caching, analytics
- Google Analytics 4: traffic analytics (IP anonymization enabled)
- RentCast: property AVM data — receives only the address you submit, not your contact info
- Federal Reserve (FRED): public mortgage-rate API — no personal data
- Microsoft Clarity: session recording and heatmaps (when activated)
- Google Maps: embedded maps
- Calendly / Zoom: when you book a call
4. SMS / text messaging (TCPA disclosure)
By submitting your phone number on the rate-alerts opt-in page (/rates) or any other form, you expressly consent to receive text messages from Jesse Oñate Real Estate at the number you provided, including informational and marketing messages. Consent is not a condition of any purchase or service. Standard message and data rates may apply. Reply STOP at any time to unsubscribe; reply HELP for help.
The rate-text service sends approximately 4-5 messages per month (one weekly Thursday rate update plus occasional follow-ups if you reply with questions).
5. Your rights — California (CCPA/CPRA)
If you are a California resident, you have the right to:
- Know: what personal information we have about you and how it's used
- Delete: your personal information (subject to legal retention requirements for real-estate transactions)
- Correct: inaccurate personal information
- Opt out of sale/sharing: we do not sell your data, but you can confirm this in writing
- Limit use of sensitive personal information
- Non-discrimination: we will not discriminate against you for exercising your rights
To exercise any of these rights, email jesse@jessetek.net with the subject "CCPA Request." We will respond within 45 days.
6. Cookies
We use cookies and similar technologies for:
- Strictly necessary: session, security, and performance (always on)
- Analytics: Google Analytics, Vercel Analytics, Microsoft Clarity (deactivated by default; activated only with your consent if required by law)
- Functional: remembering your form progress (e.g., the buyer checklist saves your checked items in localStorage)
You can disable cookies in your browser settings, though some Site functionality may break.
7. Data retention
We retain your information only as long as necessary:
- Form submissions / leads: 36 months from last interaction (real-estate brokerage standard)
- Closed transaction records: 6 years (California DRE retention requirement)
- Analytics data: 14 months (GA4 default)
- SMS subscriber records: until you reply STOP, then 12 months for compliance audit
8. Children
The Site is not directed to children under 16. We do not knowingly collect personal information from children. If you believe a child has provided us with personal information, please contact us at jesse@jessetek.net.
9. Changes to this policy
We may update this Privacy Policy from time to time. The "Last updated" date at the top reflects the most recent revision. For material changes, we will post a notice on the Site and update the date.
